A few years ago the Maine Bar Journal ran a pair of articles written by two Portland attorneys which were purportedly for the purpose of presenting the legal arguments for and against same sex marriage. I looked forward to reading them, as I was interested in finding out exactly what the ‘anti’ arguments were, as I had never been able to think of any beyond custom and tradition. The ‘pro’ article was very workmanlike, giving a lawyerly and solid review of the consitiutional situation, etc. Very nice and persuasive for lawyers, but nothing that would make Maggie Galagher cry uncle.
Next I turned to the ‘anti’ article, hoping to find work of a similar level, raising all of the arguments that I had been unable to spot myself, and possibly refuting, or at least engaging, the points raised in the ‘pro’ article.
I was astounded and disappointed at what I found! It was a crude anti-homosexual screed such as NOM would be putting out later around the People’s Veto campaign in 2009. I kid you not, it even included the line about “it was Adam and Eve in the Garden of Eden, not Adam and Steve.” There was NOT A SINGLE citation to any persuasive legal authority, just a homophobic rant. And this was in a professional publication, read almost exclusively by other lawyers. I would have been ashamed to put my name to such a piece, even if I felt that way.
My conclusion was that the anti-marriage equality position is not only morally bankrupt, but legally indefensible as well. Nothing I have witnessed in the years since has changed my mind on this point one iota.
Religious opposition is the only thing people can use to argue against same sex marriage and it is not even an argument.
